DEPORTED INTO DARKNESS: TRUMP’S WAR ON THE CONSTITUTION, THE COURTS, AND YOUR FUCKING RIGHTS
No One Is Safe Now
Kilmar Abrego Garcia didn’t break the law. He didn’t sneak into the country, didn’t sell drugs, didn’t traffic humans, didn’t run guns. He wasn’t MS-13, wasn’t even charged with a goddamn misdemeanor. He lived in Maryland with his U.S. citizen wife and three kids, including two stepchildren he helped raise like his own. He was a dad. A husband. A guy trying to live. But that wasn’t enough. Not in Trump's America.
Because on March 15, 2025, Kilmar was yanked out of his life, shackled like an animal, and deported to El Salvador. A place where he’d already won legal protection not to be sent, because returning meant persecution, torture, maybe death. But fuck court orders. Trump’s regime didn’t just ignore them, they stomped them into the dirt, laughed, and kept pushing.
This is the moment the floor drops out. This isn’t “just” immigration. This is lawlessness in a tailored suit, white nationalist fever dreams dressed up as executive authority, with the Supreme Court’s signature used as toilet paper. And now Trump wants to go further. He’s calling for the deportation of American citizens, what he calls the “homegrowns” to foreign prisons. Real people. Born here. Sent away. Gone.
And you still think this ends with immigrants?
SYSTEMIC ROTTENNESS – How We Got Here
Let’s rewind.
In 2019, a federal court granted Kilmar Abrego Garcia a “withholding of removal” under U.S. asylum law. That means the court said you can’t deport this man to El Salvador because of a clear and credible fear of persecution. His life would be in danger. That’s not a suggestion. That’s a federal order.
But on March 15, 2025, the Department of Homeland Security said, “Fuck it.”
ICE deported him anyway.
They called it an “administrative error.”
An “error” that violated the Fifth Amendment. An “error” that defied the will of a federal judge. An “error” that landed him in CECOT, a maximum-security Salvadoran prison described by human rights watchdogs as “a modern-day torture facility.”
This wasn’t some DHS intern clicking the wrong box. This was policy. This was intent.
And don’t let anyone tell you otherwise.
BOMBSHELL #1 – THEY KNEW
We’re not speculating. We have court declarations.
- ICE’s Acting Field Director Robert Cerna literally admitted in court: “This removal was an error… Abrego Garcia should not have been deported.”
- DOJ attorney Erez Reuveni conceded on the record that Kilmar should never have been removed from U.S. soil.
So why wasn’t he brought back?
Because Trump doesn’t give a shit about court orders. He’s testing how far he can go, how much law he can break before someone actually stops him.
Even after a federal judge, Paula Xinis, ordered the government to return Kilmar by April 7, the Trump administration dragged its feet. Then the Supreme Court unanimously ruled on April 10: bring him back.
And still they didn’t.
If they can ignore SCOTUS and nobody storms the gates, we’re done. That’s checkmate for democracy.
BOMBSHELL #2 – THE MS-13 LIE
Here’s the excuse they’re hiding behind: Kilmar, they claim, is MS-13.
Really? Based on what?
A suspended cop’s hearsay buried in a barely-legible document. No charges. No convictions. Nothing but a smear, manufactured to paint a Salvadoran father as a threat so that deporting him looked like law enforcement instead of a goddamn human rights violation.
Lawfare reviewed the government’s claim and found it riddled with holes. “Double hearsay,” they called it. Unverifiable, unsourced, and legally worthless.
This is how fascism functions: fabricate enemies. Frame brown men as terrorists. Use lies to make lawbreaking look like strength.
BOMBSHELL #3 – “HOMEGROWNS” ARE NEXT
On April 15, 2025, while sitting across from Salvadoran strongman Nayib Bukele in the White House, Trump didn’t whisper it. He didn’t hide it.
Trump’s Taxpayer-Funded Prison Empire
Trump’s secret alliance with El Salvador’s dictator is fueling a new era of privatized torture.
He said it out loud.
“Homegrown criminals next. I said homegrowns are next, the homegrowns. You gotta build about five more places.”
“Homegrowns.” His word for U.S. citizens. Americans. Born and raised.
And he wants them in Salvadoran prisons.
What the actual fuck?
Later, White House Press Secretary Karoline Leavitt confirmed it. Trump was “interested in deporting heinous, violent criminals who are U.S. citizens to El Salvador if there’s a legal pathway to do that.”
But there isn’t.
Because it’s illegal. It’s unconstitutional. It’s fucking insane.
Legal scholars from across the political spectrum didn’t mince words:
- Ilya Somin, George Mason University: “Obviously illegal.”
- David Bier, Cato Institute: “There is no U.S. law that allows this.”
- Justice Sotomayor (SCOTUS dissent): Warned it could lead to “expulsion of citizens without due process.”
But Trump doesn’t care. Pam Bondi is “studying the laws.” Meaning: they’re looking for loopholes to strip Americans of rights and send them offshore.
THE HUMAN COST – A FAMILY RIPPED TO SHREDS
Let’s talk about Jennifer Vasquez Sura, Kilmar’s wife. American. Working three jobs to keep the family afloat. One kid wetting the bed again. Another started therapy. And still no dad.
They’ve called senators. They’ve prayed. They’ve written letters. They’ve sat in courtrooms watching judges shake their heads and issue orders that fall like confetti, colorful, meaningless, forgotten in minutes.
In the most gut-wrenching moment of the testimony, Jennifer said:
“They said it was a mistake, but he’s still not home. My kids think the law is a joke now.”
She’s right.
If the government breaks the law and no one goes to jail, why should anyone respect it?
“WEEK IN REVIEW” , ALL SYSTEMS GOING TO HELL
The Kilmar case isn’t a fluke. It’s a symptom.
This week’s news cycle is a fucking dumpster fire of MAGA authoritarianism metastasizing in real time:
- Trump’s tariffs lit the economy on fire, killing jobs and skyrocketing grocery costs, then he blamed China for retaliating.
- Education Secretary Linda McMahon called teachers “obsolete” and proposed replacing them with AI bots programmed by PragerU. Yeah. That PragerU.
- The EU hit back with sanctions on U.S. goods over human rights violations tied to Kilmar’s deportation and El Salvador’s prison contract.
- Supreme Court emergency orders are being ignored. Like… flat-out ignored. The Constitution is being treated like optional DLC.
What do all these stories have in common?
Rule-breaking as policy. Lawlessness as brand. Cruelty as performance art.
WHAT COMES NEXT – AND WHY YOU SHOULD BE FUCKING TERRIFIED
This is the test balloon for dictatorship.
First they deport the non-citizens. Then they smear the asylum seekers. Then they create a fake legal basis to send citizens away. Foreign prisons. Secret deals. Black sites.
This is how you lose a country.
We’re not speculating here. Trump has said what he wants to do. He’s already doing it. The only thing standing in the way is a judiciary that’s being spat on and a public too numb to panic.
If Kilmar Abrego Garcia isn’t brought back, if this government can vanish a man with a court order protecting him, and then refuse a Supreme Court demand to correct it, it’s open fucking season.
And don’t think for a second it’ll stop at “heinous criminals.” MAGA has never been about law and order. It’s about control. It’s about punishing “others.” Today it’s Kilmar. Tomorrow it’s protesters. Journalists. Teachers. You.
FINAL VERDICT – WAKE THE FUCK UP
This story isn’t about immigration.
It’s about whether the U.S. government gets to erase you because someone in power doesn’t like you.
It’s about watching the White House defy the Supreme Court and daring anyone to do something about it.
It’s about Trump building a blueprint for fascism using Salvadoran prisons, American tax dollars, fake MS-13 labels, and a party of cowardly sycophants too spineless to say no.
And it’s about us.
Because if we don’t fight this with everything we’ve got, truth, law, rage, protest, ballots, platforms, then history will write 2025 as the year the U.S. Constitution stopped being real.
So let’s make this clear:
Bring Kilmar home. End the “homegrowns” insanity. Tear this illegal, authoritarian nightmare down before it spreads.
The warning signs aren’t subtle anymore.
They’re screaming. (Stay tuned for Part Two!)

Link: [SupremeCourt.gov opinion PDF – Docket 24a949]
https://www.supremecourt.gov/opinions/24pdf/24a949_lkhn.pdf
Why It Matters:
This ruling is the legal smoking gun. It documents the Supreme Court unanimously ordering the Trump administration to return Kilmar Abrego Garcia to the U.S. after his illegal deportation. When a sitting president shrugs off a direct SCOTUS mandate, we are not in a functioning constitutional republic. This is no longer a debate over immigration, it’s a full-blown crisis of executive defiance.
Whistleblower Admission – ICE Acting Director Robert Cerna
Source: Cited in multiple legal filings and testimony summaries via Reuters, PBS, and NPR.
Why It Matters:
Cerna didn’t mince words. He admitted under oath:
> “This removal was an error… Abrego Garcia was removed… due to an administrative mistake.”
This isn’t abstract. This is the federal government conceding they violated due process, in court, in writing, under penalty of perjury. This instantly flips any “oops” narrative into premeditated state failure.
Department of Justice Concession – Lawyer Erez Reuveni
Source: Legal argument summaries confirmed by Just Security and LawfareMedia.org.
Why It Matters:
Reuveni’s courtroom concession, “He should not have been sent to El Salvador”, cements bipartisan legal acknowledgment that this deportation was unconstitutional. The DOJ itself conceded guilt. It removes plausible deniability and directly implicates the Trump administration in unlawful state action.
MS-13 Allegation Breakdown – Lawfare Investigation
Source: [Lawfare: Abrego Garcia and MS-13 – What Do We Know?]
https://www.lawfaremedia.org/article/abrego-garcia-and-ms-13--what-do-we-know
Why It Matters:
This is where the government's narrative falls apart. The MS-13 label, used as the justification for ignoring the courts, is based on “double hearsay from a later suspended detective.” Lawfare’s analysis exposes this as an intelligence fabrication, an old authoritarian trick: make the target scary, the facts irrelevant, and the law optional.
Academic Expert Testimony – Ilya Somin (George Mason)
Source: Cited by NBC News, Cato Institute, Time, and NPR
Why It Matters:
Somin calls Trump’s proposal to deport U.S. citizens “obviously illegal.” That’s not just critique, it’s constitutional cannon fire from a conservative-leaning legal scholar. His framing helps defang the right-wing justification machine and makes clear that this is not a partisan issue, it’s a structural threat to constitutional order.
Civil Liberties Expertise – David Bier (Cato Institute)
Source: [NBC Political Desk]
https://www.nbcnews.com/politics/donald-trump/trump-floats-legally-questionable-proposal-deport-us-citizens-rcna201183
Why It Matters:
Bier cuts through the fog:
> “No U.S. law grants that authority.”
A free-market libertarian saying the government cannot legally deport citizens slams the door shut on MAGA’s “just find a loophole” bullshit. It shows the proposal as a deliberate push to override core civil rights.
Counterpoint Alert – Trump’s “Homegrowns” Statement
Source: [ABC News – April 15, 2025]
https://abcnews.go.com/Politics/homegrowns-trump-doubles-sending-convicted-us-citizens-foreign/story?id=120802863
Why It Matters:
The language is damning:
> “Homegrown criminals next. You gotta build about five more places.”
This wasn’t a misstatement. This was Trump laying out a roadmap. ABC captured the quote during a hot mic moment. Leavitt later doubled down. This is proof of premeditated policy, not impulsive rhetoric.
Judicial Alarm – Justice J. Harvie Wilkinson IV (4th Circuit)
Source [Just Security Legal Review]
https://www.justsecurity.org/110658/three-ways-abrego-garcias-rights-violated-two-of-which-the-government-admits/
Why It Matters:
Wilkinson warns:
> “If today the Executive claims the right to deport without due process… what assurance will there be tomorrow that it will not deport American citizens…?”
That’s the heart of the entire crisis. This isn’t about Kilmar alone, it’s about whether legal protections mean jack shit anymore.

Why It Matters:
This isn’t a single rogue incident. The Week in Review doc confirms 238 deportations already carried out to El Salvador, some involving disputed U.S. citizenship. These aren’t hypotheticals. This is fact. Documented. Redacted. FOIA’d.
